This Privacy Policy describes the privacy practices of Metalabel, Inc. (“Metalabel,” “we,” “us,” or “our”) and how we collect, use, disclose, and otherwise process personal information that we obtain through our website, and any other sites or services that link to this Privacy Policy (collectively, the “Service” or “Services”). It also tells you about your rights and choices with respect to your personal information, and how you can contact us if you have any questions or concerns. 

Please read this Privacy Policy carefully. If you do not agree with this Policy or any part thereof, you should not access or use any part of the Services. If you change your mind in the future, you must stop using the Services and you may exercise your rights in relation to your Personal Data as set out in this Privacy Policy.

About Metalabel 

Metalabel is a growing universe of knowledge, resources, and spaces for metalabels, or release clubs, where groups of people who share the same interests collaboratively make, support, and release projects. 

Metalabel allows users to purchase NFTs, tokens and other objects offered in releases using blockchain technology such as Ethereum. Blockchains are public decentralized networks. When you transact on blockchains your information, including personal information, will be made publicly available, and blockchain technology does not generally allow for data to be deleted, corrected, or restricted. If you want to ensure that your privacy rights are not affected in any way, you should not transact on a blockchain.

Personal Information We Collect

Information you provide to us. Personal information that you may provide to us through the Services includes: 

  • Contact and account information, such as your first and last name, email address, phone number, postal address, organization name, username and password.

  • Social media usernames, such as your Discord username or personal Twitter link.

  • Financial information, including payment card number, will be collected from you by our payment service provider, Stripe, should you make a payment for products on the Services.

  • Community information, such as information about your projects that you create, input, submit, post, upload, transmit, store or display on forums on our Services.

  • Information submitted in “free text” boxes, such as your responses to the questions on our “Join” page.  

  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online. 

  • Usage information, such as information about how you use the Services and interact with us, including information you provide when you use any interactive features of the Services.

  • Marketing information, such as your preferences for receiving our marketing communications, and details about how you engage with our communications.

  • Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

If you choose to use cryptocurrency to make a purchase on our Services, you share wallet information such as your cryptocurrency wallet IDs, on the blockchain.

Information We Obtain From Third Parties

  • Social media information. We may maintain pages on social media platforms and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy. 

  • Other Sources. We may obtain your personal information from other third parties, such as marketing partners and publicly available sources. 

Automatic Data Collection

We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications and other online services, such as:

  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state or geographic area.

  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.

We collect Personal Data automatically via cookies, pixel tags, local storage technologies, web beacons or similar technologies on our Services (collectively referred to as “Cookies”). Please see our Cookie Policy for more information on the tools we use for automatic data collection.

How We Use Your Personal Information

To operate and support the Services. We will use your personal information to perform our contractual obligation under our terms of use towards you, such as to:

  • Provide, operate, maintain, secure and improve our Services, including to improve website functionality. 

  • Communicate with you about our Services, including by sending you announcements, updates, security alerts, and support and administrative messages.

  • Provide support, and respond to your requests, questions and feedback.

Improve, monitor, personalize, and protect our Services and Communications. It is in our legitimate business interests to improve and keep our Services safe for our users, which includes:

  • Troubleshooting, testing and research and to keep the Services secure.

  • Investigating and protecting against fraudulent, harmful, unauthorized or illegal activity.

  • Providing customized Services and communications that may be relevant or of interest to you.

  • Conducting research and development to analyze and improve the Services and to develop new features, products and Services, including by studying the use of our Services.

Marketing. We may collect and use your personal information for marketing purposes, including:

  • Direct marketing. We may from time-to-time send you direct marketing communications via email as permitted by law. Where required by law, we will only send you marketing emails with your consent which you may withdraw at any time. Otherwise, we do so on the basis of our legitimate interests. You may opt out of our marketing communications as described in the “Opt out of marketing communications” section below.

  • To enforce our agreements, to comply with legal obligations and to defend us against legal claims or disputes. We may use your personal information in our legitimate business interests to enforce and comply with our terms and policies, to ensure the integrity of our Services and to defend ourselves against legal claims or disputes. Some processing may also be necessary to comply with a legal obligation, for example to keep records of transactions, or as requested by any judicial process or governmental agency.

How We Share Your Personal Information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection: 

Other Metalabel users. When you chose to share certain project information with the Metalabel community on our Services. This information may include your name, bio, username, and any other content that you chose to share.

Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate our Services (such as customer support, hosting, analytics, payment service providers, email delivery, marketing, and database management services).

Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance, fraud prevention, and safety purposes described above.

Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Privacy Choices

Opt-out of marketing communications. You can opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the emails you receive from us. If you do so, you will continue to receive service-related and other non-marketing emails until you cease using our Services linked to those service updates.

Online tracking opt-out. There are a number of ways to opt out of having your online activity and device data collected through our Services, which we have summarized below. Please see our Cookie Policy for more information.

Privacy rights. Depending on your location and the nature of your interactions with our Services, we also offer you the following choices that affect how we handle the personal information that we control:

Additionally, applicable law can limit these rights, for example, by prohibiting businesses from providing certain sensitive information in response to an access request and limiting the circumstances in which they must comply with a deletion request. 

You are entitled to exercise all rights described in the Privacy Choices section free from discrimination.

Limits on your choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. Cross-Border Processing of Personal Information 

As we are based in the United States, you will provide your data directly to us in the United States.  Please note that the United States, and other countries to where we may transfer your personal information, may not offer the same protections to your information as the data protection laws where you are based.  

When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for personal information and we will comply with applicable data protection laws. For example, where our websites target individuals in the European Union (“EU”) or the United Kingdom (“UK”), we may rely on an EU Commission or UK government adequacy decision or on contractual protections for the transfer of personal information. Third-Party Services

Our Services can contain links to websites and other online services operated by third parties. In addition, our content can be integrated into web pages or other online services that are not associated with us. We do not control websites or online services operated by third parties, and we are not responsible for their actions. Third parties process your Personal Data in accordance with their own privacy policies.  Please review these policies carefully before using their services.

Information Security

We use reasonable organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information. Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children

Our Services are not intended for use by children under 16 years of age. If we learn that we have collected personal information through our services from a child under 16 without the consent of the child’s parent or guardian as required by law, we will delete it.

Retention

We retain your personal information only for as long as is necessary to fulfil the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws or until you withdraw your consent (where applicable).

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you, for example through posting the Privacy Policy on our Services. 3.     What types of cookies and similar technologies does Metalabel use?

Analytics. We use “analytics” cookies that allow us to recognize and count the number of visitors and to see how visitors move around the website when they are using it. This helps us to improve the way our website works, for example by making sure users are finding what they need easily. The collected data provides us only with anonymous traffic statistics (like number of page views, number of visitors, and time spent on each page). Specifically, we use Pirsch to collect information about how users use our services, which we then use to compile reports that disclose trends without identifying individual visitors and help us improve our services. 

4.     How can you control the use of cookies?

Depending on where you access the services from, you may be presented with a cookie banner or other tool to provide permissions prior to non-Necessary cookies being set. In this case, we only set these non-Necessary cookies with your consent. You may revoke your consent at any time .
